1. Introduction

 

1.1  This website (“Website”) is owned and provided exclusively by 123Law Limited (bearing company registration no.[to be updated]). 123Law Limited trades as ‘123Law’.

 

1.2 Users of this website (“Users”) may only access, view and use this Website subject to the Terms and Conditions contained herein and our (which includes our Cookie Policy). By accessing, viewing and using this Website, Users agree and confirm that they accept these Terms and Conditions and our Privacy Policy and agree to comply with and be bound by them at all times while accessing, viewing or using this Website. If Users do not agree to these Terms and Conditions or our Privacy Policy (including our Cookie Policy), Users must cease to access, view and use this Website immediately.

 

1.3 We reserve the right to amend these Terms and Conditions and the Privacy Policy at any time and from time to time without notice to Users and such amendments shall take effect immediately unless otherwise indicated. Users should check these Terms and Conditions and the Privacy Policy every time they access, view and use this Website.

2. Access to this Website

 

2.1 Users may access, view and use this Website free of charge.

2.2 Access to this Website is permitted on a temporary basis. We may suspend, withdraw, discontinue or change this Website or any part thereof without prior notice to Users. We will not be liable to Users if for any reason this Website or any part thereof is unavailable at any time or for any period.

 

3. Our Services

3.1 The objective of 123Law is to help Users find and compare legal service providers in Hong Kong ("LSPs") that match with their legal needs and preferences ("Objective").

 

3.2 Users complete and submit an enquiry form (“Enquiry Form”) via this Website on a voluntary basis containing (i) information for the purpose of identifying Users, including their name, email address and telephone number(s) (“Personal Information”); (ii) a description of the legal service(s) they are seeking or the legal issue(s) faced by Users (“Enquiry”); (iii) preferences for the desired LSP including but not limited to the LSP’s geographical location, size, practice area(s), language(s) (“Preferences”).

 

3.3 After Users have completed and submitted the Enquiry Form, they will receive a confirmation email from us to confirm our receipt of the Enquiry Form. We may ask Users follow-up question(s) regarding the legal service(s) sought if we are of the opinion that the information contained in the Enquiry Form is insufficient or inappropriate to render a quotation from LSPs.

 

3.4 We will contact not less than 5 LSPs that we think match the Preferences of Users and inform them of the Enquiry. By submitting the Enquiry Form, Users agree that their Personal Information and Enquiry may be passed on to any LSPs chosen by us as we see fit for the sole purpose of fulfilling the Objective.

 

3.5 We retain sole discretion in choosing which LSPs to contact. However, we are not affiliated with nor sponsored by any LSPs and do not accept any commission or fees from any LSPs or related third parties that will affect which LSPs to contact. We will consider (i) Enquiry; (ii) Preferences; (iii) feedback provided by our past Users to us; (v) feedback provided by LSPs to us.

3.6 Should the LSPs choose to respond to the Enquiry, the LSPs will contact Users directly by the Personal Information. The LSPs may ask Users follow-up questions regarding the Enquiry if necessary for the purpose of providing a more accurate quotation to Users. Users may also ask any questions directly to the LSPs. 123Law will not have any control over or any information about any direct discussion between the LSPs and Users, unless and until users agree and choose to disclose that information to us.

 

3.7 123Law is not a solicitors’ firm and does not offer or provide any legal advice. Any information provided by us is provided for the purpose of enabling Users to select the appropriate LSP that matches with their needs. Nothing on this Website is or shall be deemed to constitute legal advice.

 

3.8 Our Website is free to use and without obligation. Users may re-submit an Enquiry Form if they choose not to engage any of the LSPs responding to the Enquiry. We do not add any fees or commissions to the quotations Users receive from the LSPs.

 

3.9 We aim to provide uninterrupted access to this Website but give no warranty as to the uninterrupted availability of this Website. We reserve the right to suspend, restrict or terminate Users’ access to this Website at any time. We reserve the right to add, amend, delete, edit, remove or modify any information, content, material or data displayed on this Website and without notice from time to time.

 

3.10 If a User provides information on behalf of another party, the User must obtain permission and consent from that party before providing it to us. In submitting another person’s details, the User confirms to us that he/she has the other party’s permission and consent to do so and that the other party is fully aware of how his/her information will be used.

 

3.11 We will only retain Users’ information and data for the primary purpose of and up to the point of contacting LSPs. We will not use Users’ information and data for any marketing or advertising purposes. For more information, please read our Privacy Policy.

 

4. Limitation

4.1 All conditions, warranties, representations or other terms which may apply to the Website or any content on it, whether express or implied, are excluded to the extent permitted by law.

 

4.2 We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect a User’s computer equipment, computer programs, data or other proprietary material due to the User’s use of our Website or to the User’s downloading of any content on it, or on any website linked to it.

 

4.3 We assume no responsibility or liability for any of the services provided by LSPs responding to the Enquiry. Should Users decide to engage any of these LSPs, the engagement will be directly between the Users and the LSPs on their own terms and conditions. 123Law has no contractual involvement, and will not be liable in contract or otherwise for the services provided by the LSPs to the Users. Users must ensure that they understand and agree with the terms and conditions of the LSPs before entering into a contract. It is the Users’ responsibility to satisfy themselves that they wish to obtain the services from the LSPs before doing so. We are not responsible or liable for any loss or damage the Users may suffer or incur in connection with the terms and conditions applying to any contract entered into by them with the LSPs in relation to any service or for any acts, omissions, errors or defaults of the LSPs in connection with those terms and conditions.

 

4.4 Any views, opinions, advice or assistance which is given or provided to the Users by a LSP after using this Website do not represent our views, opinions, advice or assistance and are not checked, monitored, reviewed, verified or endorsed by us. We do not endorse, recommend or take responsibility for any LSP who provides Users with any views, opinions advice or assistance. Users act or refrain from acting on any LSP’s views, opinions, advice or assistance at their sole risk and sole discretion and are solely responsible for any decision to act or refrain from acting on such views, opinions, advice or assistance. We are not responsible or liable for any loss or damage Users may suffer or incur in connection with such views, opinions, advice or assistance including in relation to their accuracy, truthfulness or completeness or for any acts, omissions, errors or defaults of LSPs or any third party in connection with such views, opinions, advice or assistance. We do not assist or provide any advice, legal or otherwise, to LSPs.

 

 

5. Entire Agreement

 

5.1 These Terms constitute the entire agreement between Users and us relating to Users’ access to and use of this Website and supersedes any prior agreements (including any previous terms of use of this Website).

6. Prevailing Language

6.2 These Terms (and our Privacy Policy) are drawn up in English and Chinese language versions. In case of any inconsistencies between the two versions, the English version shall prevail

 

7. Governing Law

7.1 These Terms and Conditions and Users’ access to and use of this Website shall be governed by and interpreted in accordance with Hong Kong law and by accessing and using this Website, Users agree to submit to the exclusive jurisdiction of the courts of Hong Kong.
