123Law is committed to safeguarding the privacy of the users of this website (www.123lawhk.com) (“Website”).

This policy sets out the following:

(a) the types of information that we may collect from public users (“Public Users”) and legal service provider users (“LSP Users”) when accessing, viewing and using the Website, using our services or otherwise interacting with us;

 

(b) how we use, share, store and secure the information collected from Public Users and LSP Users (collectively, ); and

 

(c) how the information may be accessed and controlled by the Users.

  1. Types of information we may collect from a Public User

1.1 We set out the following types of information that we may collect from a Public User:

(a) information contained in the enquiry form via the Website completed and submitted by a Public User on a voluntary basis, including any (i) information for the purpose of identifying a Public User, including their name, email address and telephone number(s) (“Public User Personal Information”); (ii) description of the legal service(s) he/she is seeking or the legal issue(s) faced by a Public User; (iii) preferences for the desired legal service provider (“LSP”) including but not limited to the LSP’s geographical location, size, practice area(s), language(s);

(b) information relating to the access, view and usage of the Website from a Public User’s device, including his/her Internet Protocol (“IP”) address, geographical location, browser type and version, operating system, referral source, length of visit, page views, website navigation paths, timing, frequency and pattern of the Public User’s access, view and usage of the Website (“Usage Data”);

(c) information a Public User provides on a voluntary basis through our customer support / service channels, for example when a Public User reports a problem to us or interacts with our customer support team, including any contact information, communication, documentation, photos, images and screenshots (“Support Data”);

(d) information that a Public User posts on a voluntary basis for publication on the Website such as testimonials, reviews, comments and ratings (“Publication Data”); and

(e) information that a Public User provides on a voluntary basis relating to his/her feedback and experiences on a particular LSP engaged by him/her (“Feedback Data”).

1.2 We set out the following types of information that we may collect from a LSP User:

(a) contact information about the LSP User including the name(s) of their contact person(s), email address(s) and telephone number(s) (“LSP User Personal Information”);

(b) the LSP User’s Usage Data and Support Data.

1.3. We collect the information identified in paragraph 1 above when the Users provide them to us on a voluntary basis and when the Users access, view or use the Website. However, we may also obtain the above information about the Users from other sources, such as our service providers who provide technical, payment, delivery, advertising networks, analytics, market research, and search information services.

1.4. In addition to the types of information above, in the course of rendering our services, we may be included as a party to email communications between the Public User and the LSP User on a voluntary basis. However we shall only remain as a party in such communications insofar as necessary to render our services.

2. How we use the information we collect

2.1 We set out the following circumstances in which we may use the Public User Personal Information and LSP User Personal Information (collectively, “Personal Information”):

(a) when we perform the contract we have entered into (or are about to enter into) with the Users, including to provide our services, to provide customer support, and to protect the safety and security of the Website;

(b) where it satisfies a legitimate interest which is not overridden by the Users’ fundamental right or data protection interests. Such legitimate interest includes but is not limited to research and development to improve our services and to protect the Website’s legal rights and interests;

(c) where we have obtained the Users’ consent or permission to do so for a specific purpose, such as to publish their comments and/or information on the Website; and

(d) where we need to comply with a legal or regulatory obligation.

2.2If a User has given us consent or permission to use the Personal Information for a specific purpose, the User has the right to withdraw the consent or permission at any time by contacting us. However this will not affect any use of the information that has already taken place.

2.3 We do not share the Personal Information with any third parties outside our company for marketing purposes, unless with the express consent of the User providing the Personal Information.

 

3. How we share the information we collect

3.1 We share information with third parties that help us operate, provide, support, improve and market our services, for example third-party service providers who provide cloud hosting, maintenance, backup, storage, infrastructure, billing, payment processing, customer support, business analytics and other services.

3.2 Third-party service providers may have access to the Personal Information only for the purpose of performing their services and in compliance with the applicable laws and regulations.

3.3 If Users use any third-party software in connection with our services, for example any third-party software that the Website integrates with, the Users agree to give the third-party software provider access to the Personal Information. Policies and procedures of third-party software providers are not controlled by us, and this policy does not cover how the Personal Information is collected or used by third-party software providers. We encourage Users to review the privacy policies of third-party software providers before using the third-party software.

3.4 The Website may contain links to third-party websites over which we have no control. If Users follow a link to any of these websites or submit information to them, the information will be governed by their policies. We encourage Users to review the privacy policies of third-party websites before submitting information to them.

3.5 We may share Users’ information with government and law enforcement authorities to comply with applicable laws or regulations, for example when we respond to claims, legal processes, law enforcement, or national security requests.

3.6 If we are acquired by a third party as a result of an acquisition or business transfer, the Personal Information may be disclosed and/or transferred to a third party in connection with such transaction. We will notify the affected Users if such transaction takes place and inform Users of any choices they may have regarding their information.

4. How we store and secure the information we collect

4.1 The Website is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to provide our services to the Users. Users’ Personal Information, Usage Data, Support Data, Publication Data, Feedback Data and all other data the Website stores in accordance with this Privacy Policy may be stored through Wix.com’s data storage, databases and the general Wix.com applications. 4.2 In order to protect the security and integrity of the Personal Information, we regularly review our information collection, storage and processing practices.

4.3 While we implement safeguards designed to protect our Users’ information and data, please note that no transmission of information or data on the Internet is completely secure. We cannot guarantee that any information or data, during transmission through the Internet or while stored on our systems or processed by us, is absolutely safe and secure.

4.4 We only retain the information identified in paragraph 1 above for so long as it is reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. After such time, we will delete the Users’ information, or if this is not possible, we will isolate such information from further use. We periodically review the basis and appropriateness of our data retention policy.

5. Our Users’ rights

5.1 Our Users have the right to:

 

(a) be informed of what we do with their Personal Information;

(b)request a copy of Personal Information we hold about the User in a structured, commonly used and machine readable format;

(c) require us to correct any inaccuracy or error in any Personal Information we hold about the User;

(d) request erasure of the User’s Personal Information ); and

(e) object to or restrict the processing by us of the Personal Information (including for marketing purposes).

5.2  As a security measure, we may need specific information from the User to help us confirm the User’s identity when processing the privacy requests or when the User exercises his/her rights.

 

5.3 We aim to respond to all legitimate requests within one (1) calendar month. Occasionally, it may take us longer if the request is particularly complex or if a number of requests have been made.

 

5.4 Our Users may withdraw the consent or permission at any time where we are relying on Users’ consent or permission to process the Personal Information (although this will not affect the lawfulness of any processing carried out before the User withdraws his/her consent). Also, we may not always be able to comply with our Users’ request of erasure if the Personal Information is necessary for the purpose which we originally collected it for, record keeping or legal compliance purposes. We also cannot guarantee the erasure or correction of any Personal Information that has been passed to third parties.However, we will notify those third parties of the User’s request for erasure or correction or inaccuracy or error in the Personal Information.

6. Changes to this policy

6.1 We may amend this policy from time to time by posting the updated policy on the Website. By continuing to access, view and use the Website after the changes come into effect, our Users agree to be bound by the updated policy.
